1. Acceptance of Terms

By accessing or using AIFinNav's website (aifinnav.ai) and services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms constitute a legally binding agreement between you and AIFinNav.

2. Description of Service

AIFinNav provides AI-powered financial planning and analysis (FP&A) tools for businesses, including but not limited to:

• AI Revenue Forecasting
• Scenario Planning and Modeling
• Budget vs. Actual Tracking
• Cash Flow Forecasting
• FP&A Benchmark Reports
• AI Variance Analysis
• FP&A Maturity Assessments

Services are available on a pay-per-outcome basis or through monthly subscription plans.

3. AI Accuracy Disclaimer

This is critical. Please read carefully.

All financial outputs generated by AIFinNav — including forecasts, scenario models, variance analyses, cash flow projections, benchmark comparisons, and any other outputs — are generated using artificial intelligence and are provided for informational purposes only.

• AIFinNav outputs do not constitute tax advice, accounting advice, audit services, investment advice, or legal advice.
• AI-generated financial projections are estimates based on the data you provide and historical patterns. Actual results may differ materially from any projections.
• AIFinNav is not a licensed financial advisor, CPA, auditor, or tax professional. Our tools supplement — they do not replace — qualified professional advice.
• You should always verify AI-generated outputs with a qualified financial professional (CPA, CFO, financial advisor) before making business, investment, or tax decisions.
• AIFinNav does not guarantee the accuracy, completeness, or timeliness of any outputs.

4. User Responsibilities

• You are responsible for the accuracy and completeness of data you provide to AIFinNav.
• You are responsible for verifying AI outputs before relying on them for business decisions.
• You will not use AIFinNav outputs as the sole basis for material financial decisions without independent professional verification.
• You will not misrepresent AI-generated outputs as certified, audited, or professionally reviewed financial statements.
• You will comply with all applicable laws and regulations in your use of the service.

5. Intellectual Property

5.1 Your Data

You retain full ownership of all financial data you upload to AIFinNav. We do not claim ownership of your data. See our Privacy Policy for details on data handling.

5.2 AI Outputs

AI-generated outputs (forecasts, reports, analyses) are delivered to you as the purchaser. You may use, distribute, and modify these outputs for your business purposes. We retain no exclusive rights over outputs generated from your specific data.

5.3 Our Platform

The AIFinNav platform, models, algorithms, benchmark datasets, and all other proprietary technology remain the exclusive property of AIFinNav and KCENAV.AI.

6. Payment Terms

6.1 Pay-Per-Outcome

Individual tool runs are charged at the listed price at the time of purchase. Payment is due before output delivery. All sales are final; refunds are at AIFinNav's sole discretion.

6.2 Subscriptions

Monthly subscriptions are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. No prorated refunds for partial months.

6.3 Price Changes

We may change pricing with 30 days' notice. Existing subscribers retain their current price for the remainder of their billing cycle.

7. Limitation of Liability

To the maximum extent permitted by law:

• AIFinNav shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service or reliance on AI-generated outputs.
• AIFinNav's total liability for any claim arising from the service shall not exceed the amount you paid to AIFinNav in the 12 months preceding the claim.
• AIFinNav is not responsible for business decisions made based on AI-generated outputs, regardless of accuracy.
• AIFinNav is not responsible for losses resulting from data inaccuracies in your uploaded financial data.

8. Indemnification

You agree to indemnify and hold harmless AIFinNav, its affiliates (including KCENAV.AI), officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, violation of these terms, or reliance on AI-generated outputs.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may suspend or modify the service for maintenance, updates, or in response to security incidents. We will provide reasonable notice for planned downtime.

10. Account Termination

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or misuse the platform. Upon termination, your access to the platform and stored data will be revoked after a 30-day grace period for data export.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.

12. Changes to Terms

We may update these terms with 30 days' notice. Continued use after the notice period constitutes acceptance of the updated terms.
